The elements on the website are freely accessible for browsing purposes only. Any kind of distribution, reproduction, processing and exploitation of the material (including parts thereof) outside the limits of copyright law requires the prior written consent of the respective author. The distribution and reproduction of the material in question (including parts thereof) in printed or electronic form within the limits of copyright law are only permitted with the express naming of the author. Downloading or copying content, images, photos or other files does not transfer any rights regarding the content. The names and logos used are registered and therefore protected trademarks, so there is no right to use the images, names and logos. Respire Est. reserves all rights with regard to the entire content of the website except for the rights of third parties.

Limitation of liability for own content

Although Respire Est. takes every care to ensure the accuracy of the information published, it and its contractual partners cannot give any warranty (including to third parties) as to the timeliness, completeness, correctness and accuracy of the information contained on the website at the time of its publication. Liability claims against Respire Est. for material or immaterial damage resulting from access to or use or non-use of the published information, misuse of the connection or technical faults, as well as direct and indirect consequential damage are excluded. Privacy

Respire Est. operates the www.nadinerass.com and www.respire.academy websites and is responsible for the collection, processing and use of your personal data. Respire Est. is therefore also responsible for ensuring that all data processing is carried out in accordance with applicable law. The protection of your personal data is very important to us. We take the issue of data protection seriously and pay attention to the security of your data. We comply with all applicable legal requirements, in particular the Liechtenstein Data Protection Act (DPA) LGBl-Nr. 2018.272 of Oct. 4, 2018 and the related Data Protection Ordinance (DPO) LGBl-Nr. 2018.272 of Dec. 11, 2018. Where applicable, we also comply with the provisions of the European Union's General Data Protection Regulation (GDPR). It is important to us that you know what personal data we collect from you, how this is done, how this data is processed and for what purposes this is done. By using our website, you declare your consent to all of this data processing within the meaning of Art. 6 Para. 1 lit. a DSGVO. Therefore, please read the following information carefully.

What data do we process when you visit our website?

When you visit our website, our servers temporarily store each access in a log file. The following data is automatically recorded:

  • the IP address of the requesting computer

  • the date and time of the access

  • the name and URL of the accessed file

  • the website from which the access was made

  • the operating system of your computer and the browser you are using

  • the country from which you accessed the site and the language settings of your browser

  • the name of your Internet access provider

This data is collected and processed to enable the use of our website (connection establishment), to ensure system security and stability, for the optimization of our Internet offering and for internal statistical purposes. In particular, the IP address is used to record your country of residence and to make the appropriate settings (e.g. language). The IP address is also stored in order to be able to react appropriately to attacks on our network infrastructure. In all these purposes lies our legitimate interest in this data collection and data processing within the meaning of Art. 6 para. 1 lit. f DSGVO.

What data do we process when you subscribe to our newsletter?

On our website you have the possibility to subscribe to our newsletter. Registration is required for this. The following data must be provided as part of the registration:

  • Salutation (mandatory)

  • First and last name (mandatory)

  • E-mail address (mandatory)

This information is necessary for data processing. In addition, you can voluntarily provide further data (date of birth and country). We process this data exclusively in order to personalize the information and offers sent to you and to better align them with your interests.

We use Active Campaign to send our newsletter. You can find Active Campaign's privacy policy at https://www.activecampaign.com/legal/privacy-policy. Please also read this privacy policy carefully. Our newsletter may also contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is a 1x1 pixel, non-visible graphic that is associated with the user ID of the respective newsletter subscriber.

The recourse to corresponding services makes it possible to evaluate whether the emails containing our newsletter have been opened. In addition, this also allows the click behavior of the newsletter recipients to be recorded and evaluated. We use this data for statistical purposes and to optimize the newsletter in terms of content and structure. This enables us to better tailor the information and offers in our newsletter to the individual interests of the respective recipient. The tracking pixel is deleted when you delete the newsletter. To prevent tracking pixels in our newsletter, please set your mail program so that no HTML is displayed in messages.

By registering, you give us your consent for the processing of the data provided for the regular sending of the newsletter to the address you have provided and for the statistical analysis of user behavior to optimize the newsletter. This consent constitutes our legal basis for the processing of the aforementioned personal data within the meaning of Art. 6 para. 1 lit. a DSGVO. In the aforementioned evaluation purposes also lies our legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

At the end of each newsletter, a link is listed that allows you to unsubscribe from the newsletter at any time. You can unsubscribe for the entire newsletter or only for certain channels. If you unsubscribe from the entire newsletter, all your related data will be deleted from our system.

Which of your data is collected and processed for advertising purposes?

In the following section, we would like to show you which of your data is collected and processed for advertising purposes and how this is done. This data processing is all based on a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO, whereby our interest lies in particular in direct marketing and the analysis and evaluation of the use of our website. By using our website, you also give us your consent to this data processing within the meaning of Art. 6 para. 1 lit. a DSGVO.

Creation of pseudonomy usage profiles

In order to provide you with personalized services and information on our website (on-site targeting), we use and analyze the data we collect about you when you visit the website. In the corresponding processing, so-called cookies may also be used if necessary (for more details, see section IV). The analysis of your user behavior may lead to the creation of a so-called usage profile. A combination of the usage data only takes place with pseudonyms, but never with non-pseudonymized personal data.

To enable personalized marketing in social networks, we integrate so-called remarketing pixels from Facebook and Twitter on the website. If you have an account with a social network included via this and are logged in there at the time of the page visit, this pixel links the page visit with your account. If you wish to prevent this link, you must log out of your respective account before visiting the site. You can also make further settings for advertising in the respective social networks in your user profile.

Retargeting

We use so-called retargeting technologies on the website. This involves analyzing your user behavior on our website in order to be able to offer you customized advertising on partner websites. Your user behavior is recorded pseudonymously. Most re-targeting technologies work with so-called cookies (for more information on cookies, see section IV).

Our website uses Google AdWords Remarketing and Doubleclick by Google, services of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043,USA ("Google"), to display ads based on the use of previously visited websites. Google uses the so-called DoubleClick cookie for this purpose, which enables your browser to be recognized when you visit other websites. The information generated by the cookie about your visit to these websites (including your IP address) will be transmitted to and stored by Google on servers in the United States (for more information on transfers of personal data to the United States, please refer to section 10).

Google will use this information for the purpose of evaluating your use of the website with regard to the advertisements to be displayed, compiling reports on website activity and advertisements for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf.

To manage the services for usage-based advertising, we also use the Google Tag Manager. The Tag Manager tool itself is a cookie-less domain and does not collect any personal data. Rather, the tool provides for the triggering of other tags, which in turn may collect data. If you have disabled at the domain or cookie level, it will remain in place for all tracking tags implemented with Google Tag Manager.

You can prevent re-targeting at any time by rejecting or switching off the relevant cookies in the menu bar of your web browser (for more information on cookies, see section V). In addition, you can request an opt-out for the aforementioned additional advertising and re-targeting tools via the Digital Advertising Alliance website at optout.aboutads.info.

Twitter Analytics

On our website, we use the visitor action pixel of Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA("Twitter") for statistical purposes. The pixel makes it possible to track the behavior of users after they have been redirected to our website by clicking on a Twitter advertisement. This procedure is used to evaluate the effectiveness of Twitter ads for statistical and market research purposes and can thus help to optimize future advertising measures.

The data collected in this process does not allow us to draw any conclusions about the identity of the users. However, the data is stored and processed by Twitter so that a connection to the profile of the respective user is possible and Twitter can use the data for its own advertising purposes. This data can enable Twitter and its partners to place advertisements on and outside of Twitter. Furthermore, a cookie can be stored and read on the computers of users for these purposes.

What are cookies and what are they used for?

Cookies are information files that your web browser automatically stores on your computer's hard drive when you visit our website. Cookies help us to make your visit to our website easier, more pleasant and more meaningful. For example, we use cookies to better tailor the information, offers and advertising we display to your individual interests. Most Internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a message always appears when you receive a new cookie. However, deactivating cookies may mean that you cannot use all the functions of our website.

What are tracking tools and what are they used for?

On our website we use various additional so-called tracking tools. With these tracking tools, your surfing behavior on our website is observed. This observation takes place for the purpose of demand-oriented design and continuous optimization of our website. In this context, pseudonymized usage profiles are created and cookies are also used. Matomo (formerly Piwik)

This website uses the open source web analytics service Matomo. Matomo uses technologies that enable the cross-page recognition of the user for the analysis of user behavior (e.g. cookies or device fingerprinting). The information collected by Matomo about the use of this website is stored on our server. The IP address is anonymized before storage.

With the help of Matomo, we are able to collect and analyze data about the use of our website by website visitors. This allows us to find out, among other things, when which page views were made and from which region they come. We also collect various log files (e.g. IP address, referrer, browsers and operating systems used) and can measure whether our website visitors perform certain actions (e.g. clicks, purchases, etc.).

The use of this analysis tool is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its website and its advertising. If a corresponding consent has been requested (e.g. consent to store cookies), the processing is based exclusively on Art. 6 (1) lit. a DSGVO; the consent can be revoked at any time.

We host Matomo exclusively on our own servers, so that all analysis data remains with us and is not passed on.

What are social media plugins and what are they used for?

The social media plugins described below are used on our website. The plugins are deactivated by default on our website and therefore do not send any data. By clicking on the corresponding social media button, you activate the plugins. If these plugins are activated, your browser establishes a direct connection with the servers of the respective social network as soon as you call up one of our websites. The content of the plugin is transmitted by the social network directly to your browser, which then integrates it into the website. The plugins can be deactivated again with one click. Further important information can be found in the respective privacy statements of the social networks listed below.

Facebook

Social plugins from Facebook are used on our website to make our website more personal. This is an offer from the US company Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA.

We use the "LIKE" or "SHARE" button for this purpose. By integrating these plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can directly assign your visit to our website to your Facebook account. If you interact with the plugins, for example by clicking the "LIKE" or "SHARE" button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.

Facebook may use this information for the purposes of advertising, market research and demand-oriented design of the Facebook pages. For this purpose, Facebook creates usage, interest and relationship profiles, e.g. to evaluate your use of our website with regard to the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website and to provide other services associated with the use of Facebook.

Twitter

Plugins of the short message network Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA are integrated on our website. You can recognize the Twitter plugins (tweet button) by the Twitter logo on our site. You can find an overview of the tweet button under the following link http://dev.twitter.com . If you have activated social plugins, a direct connection is established between your browser and the Twitter server. Twitter thereby receives the information that you have visited our site with your IP address. If you click the Twitter "tweet button" while logged into your Twitter account, you can link the content of our pages on your Twitter profile. This allows Twitter to associate the visit to our pages with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Twitter. If you do not want Twitter to be able to associate your visit to our pages, please log out of your Twitter user account.

YouTube

In addition, third-party providers can set so-called third-party cookies on your end device due to the use of various plugins on our website. We implement all plugins used, for example, to integrate a YouTube video with a 2-click solution, i.e. the third-party providers can only set cookies or receive information about your visit to our website when you have actively clicked on the respective plugin. For a description of the cookies, how they work, their purpose and the options for objecting to them, please refer to the explanations under "XI.2 Use of YouTube".

Instagram

When you come across one of our pages that have Instagram features (such as Instagram images or plug-ins) built in, your browser automatically connects to Instagram's servers. In the process, data is sent to Instagram, stored and processed. And this is regardless of whether you have an Instagram account or not. This includes information about our website, about your computer, about purchases made, about advertisements you see and how you use our offer. Furthermore, the date and time of your interaction with Instagram is also stored. If you have an Instagram account or are logged in, Instagram stores significantly more data about you.

Via small text files (cookies), which are usually set in your browser, the collected data is transmitted to Facebook. Depending on the Instagram functions used and whether you have an Instagram account yourself, different amounts of data are stored.

We assume that Instagram's data processing works in the same way as Facebook's. This means that if you have an Instagram account or have visited www.instagram.com, Instagram has at least set a cookie. If this is the case, your browser sends information to Instagram via the cookie as soon as you come into contact with an Instagram function. After 90 days at the latest (after matching), this data is deleted again or anonymized. Although we have intensively studied Instagram's data processing, we cannot say exactly what data Instagram collects and stores.


Below we show you cookies that are set in your browser at least when you click on an Instagram feature (such as button or Insta image). In our test, we assume that you do not have an Instagram account. Of course, if you are logged in to Instagram, significantly more cookies are set in your browser.

Linkedin

Our website uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Each time one of our pages containing LinkedIn functions is accessed, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our web pages with your IP address. If you click the "Recommend button" of LinkedIn and are logged into your account at LinkedIn, it is possible for LinkedIn to assign your visit to our website to you and your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by LinkedIn.

LinkedIn always receives information via the LinkedIn plugin that the data subject has visited the website if the data subject is logged into LinkedIn at the same time as calling up the AMP RAe website; this takes place regardless of whether the data subject clicks on the LinkedIn plugin or not. If the data subject does not want this information to be transmitted to LinkedIn, he or she can prevent the transmission by logging out of his or her LinkedIn account before calling up the website.

LinkedIn offers the possibility to unsubscribe from email messages, SMS messages and targeted ads as well as to manage ad settings at https://www.linkedin.com/psettings/guest-controls. LinkedIn also uses partners such as Quantcast, Google Analytics, BlueKai, DoubleClick, Nielsen, Comscore, Eloqua and Lotame, which may set cookies. Is collected data passed on to third parties?

We will only disclose your personal data if you have expressly consented to this, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the relationship between you and Respire Establishment. In addition, we pass on your data to third parties insofar as this is necessary in the context of the use of the website for the provision of the services you have requested as well as the analysis of your user behavior, as described above. Insofar as this is necessary for the aforementioned purposes, the transfer may also take place abroad. Where our website contains links to third-party websites, Respire Establishment no longer has any influence on the collection, processing, storage or use of personal data by the third party once you have clicked on these links and, to the extent permitted by law, accepts no responsibility or liability for this.

Will data be transferred abroad?

General

Respire Establishment is entitled to transfer your personal data also to third parties (i.e. contracted service providers) abroad, if this is necessary for the data processing described in this privacy policy. These third parties are obligated to data protection to the same extent as we are. If the level of data protection in a country does not correspond to that in Switzerland or the EU, we contractually ensure vis-à-vis the third party that the protection of your personal data corresponds to that in Switzerland or the EU at all times.

Data transfers to the USA

For the sake of completeness, we would like to point out that in the USA there are monitoring measures by US authorities which generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This is done without any differentiation, limitation or exception based on the objective pursued and without any objective criterion that would make it possible to limit the access of the US authorities to the data and their subsequent use to very specific, strictly limited purposes that are capable of justifying the interference associated both with the access to these data and with their use. In addition, we would like to point out that there are no legal remedies in the United States that allow you to access the data concerning you and to obtain its correction or deletion, or that there is no effective legal protection against general access rights of U.S. authorities.

We want to make you aware of this legal and factual situation so that you can make an appropriately informed decision about consenting to the use of your data. We would also like to point out to users residing in a member state of the EU that, from the perspective of the European Union, the USA does not have a sufficient level of data protection - among other things, due to the issues mentioned in this section.

To the extent that we have explained in this privacy statement that recipients of data (such as Google, Facebook and Twitter) are based in the USA, we will ensure either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield that your data is protected with our partners with an appropriate level.

Data security and confidentiality

We use appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss and against unauthorized access by third parties. Our security measures are continuously improved according to the latest state of the art.

It is important that you always keep your payment information (especially credit card data) confidential. We recommend that you close the browser window when you have finished communicating with us, especially if you are sharing a computer with other people.

We also take internal company data protection very seriously. Our employees and the service companies commissioned by us have been obligated by us to maintain confidentiality and to comply with the provisions of data protection law.

Data retention

We store personal data only for as long as is necessary,

  • to use the tracking, advertising and analysis services mentioned above within the scope of our legitimate interest;

  • to carry out, to the extent mentioned above, services that you have requested or to which you have given your consent;

  • to comply with our legal obligations.

We retain data in connection with the conclusion or fulfillment of a contract for a longer period of time because we are required to do so by legal retention obligations, for example in accounting regulations and tax law. According to these regulations, business communication, concluded contracts and accounting vouchers must be kept for up to 10 years. If we no longer need this data to perform services for you, the data is generally blocked. This means that the data may then only be used for accounting and tax purposes.

Your rights

You have the right to receive information about the personal data stored by us about you free of charge upon request. In addition, you have the right to correct inaccurate data and the right to have your personal data deleted, insofar as this does not conflict with a legal obligation to retain the data or an authorization that allows us to process the data. In accordance with Articles 18 and 21 DSGVO, you also have the right to request restriction of data processing and to object to data processing. You also have the right to demand that we return the data you have provided to us (right to data portability). Upon request, we will also pass on the data to a third party of your choice. You have the right to receive the data in a common file format.

If data processing is based on your consent, you can revoke this consent at any time.

You can also tell us what you want to happen to your data after your death by giving us appropriate instructions. In order to process your requests, we may, at our discretion, require proof of identity.
